| | Announcement pursuant to section 93 para 2 of the Austrian Stock Exchange Act BUWOG AG: Clarification of JPMorgan´s Chase & Co. notification of voting rights dated 23 January 2015 JPMorgan Chase & Co. notified on 29 January 2015 pursuant to section 92a in connection with sections 91 et seq. of the Austrian Stock Exchange Act clarifying the notification dated 23 January 2015 as follows. In regards to the notification under sec 91 of the Austrian Stock Exchange Act made by JPMorgan Chase & Co. on 23 January 2015, JPMorgan Chase & Co., along with its controlled undertaking J.P. Morgan Securities plc*, 25 Bank Street, Canary Wharf, London E14 5JP, United Kingdom (together ?JPMorgan?), makes the following clarification: 1. Notification is hereby made pursuant to section 91a of the Austrian Stock Exchange Act. 2. The notification on 23 January 2015 incorrectly stated that JPMorgan?s total interests in the voting rights of BUWOG AG, consisting of all its holdings of, ownership interests in, and/or financial
instruments relating to BUWOG AG shares and/or bonds exchangeable for BUWOG AG shares, decreased below the 5% threshold on 21 January 2015 to interests in 4,974,383, or 4.994%, of the voting shares of BUWOG AG. This was due to the fact that the notification did not take into account JPMorgan?s existing right to borrow a certain number of voting shares of BUWOG AG under a securities lending agreement. 3. In fact, JPMorgan?s aggregate holdings of and financial instruments relating to BUWOG AG shares were and continue to remain above 5%, but below 10%. More specifically, on 21 January 2015, JPMorgan held (i) 1,397,486 voting shares of BUWOG AG (or 1.40%) and (ii) financial instruments relating to 6,426,897 voting shares of BUWOG AG (or 6.45%), which together constituted a total of 7,824,383, or 7.85%, of the outstanding voting shares of BUWOG AG. * Subsidiary which is controlled, directly or indirectly (via intermediate holding companies), by JPMorgan Chase & Co.
