| | ENEFI Energy Efficiency Plc. EXTRAORDINARY ANNOUNCEMENT1 pursuant to the Capital Market Act and to decree No. 24/2008 (VIII. 15.) of the Minister of Finance ENEFI Energy Efficiency Plc. (the ?Company?) hereby notifies its reputable Investors that Uzina Electrică Zalău SA (hereinafter: CET) initiated legal proceeding against Energy Generation SA for the payment of RON 202,578.36 VAT difference as pursuant to CET the State Audit Office established that in 2011 the amount of the VAT payable in connection with sale and purchase of the real property acquired by Energy Generation SA had been incorrectly calculated. Neither the claim nor the summon order had been delivered to the company yet. Energy Generation disputes the claim, especially as the real property had been acquired in a public tender process at the price set out in the tender documentation and the claim of CET expired as the three years term of limitation had passed. CET initiated further legal proceeding becoming acquainted with the above and
asked in a ?fast track process? the court to prohibit Energy generation SA to sell the real property before closing the previously initiated legal process. Pursuant to Romanian law ?fast track processes? may be held and decided in without summoning the parties. Details in the enclosure. | | | | | | | | | | |
